LAS CRUCES – On Monday, a Las Cruces woman was so hungry, she rode her bicycle to the Sonic on El Paseo Road, ordered some food and when the server asked for payment, allegedly told him, “this one’s on God.”
The server told her, “That’s not how this works,” and tried to keep the food from her, but the woman allegedly threatened him and came toward him for the meal.
Court documents state the server, in fear of getting harmed, gave the woman the meal she’d ordered and ran back into the restaurant where he called police.
Police later found the woman — Delila Hernandez — in a park eating the meal she’d allegedly stolen.
Court documents state Hernandez told officers she knew what she’d done was wrong, and even hesitated to eat the meal because she knew it was wrong, but decided to eat it because she was “starving.”
Hernandez, 30, was arrested and charged with a felony robbery. However, the charge may be reduced.
Roxanne Garcia-McElmell, public information officer for the Third District District Attorney’s Office, said Hernandez will most likely end up charged with a petty misdemeanor of under $250, and be made to pay back the restaurant, and possibly fined a small amount, or the charges may be dropped altogether.
